In compliance with the provisions of Spanish Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI-CE), the following information is provided regarding the service provider of this website, www.callnak.com (hereinafter the “WEBSITE” or “PLATFORM”).

Accordingly, the service provider of the WEBSITE is CALLNAK BRAND, S.L. ACCESS AND TERMS OF USE

Any person accessing and/or using the WEBSITE shall be considered a user (hereinafter the “USER”).

Access to the WEBSITE is subject to the USER’s prior reading and acceptance of the terms, conditions and other legal notices contained in this document and published on the WEBSITE.

If the USER does not accept the terms, conditions and other legal notices contained in this document and published on the WEBSITE, the USER must refrain from accessing and/or using the services offered through the WEBSITE.

The USER must use the WEBSITE lawfully, in compliance with applicable legislation and respecting the legitimate rights and interests of CALLNAK and any third party, while refraining from causing any direct or indirect damage or harm.

The USER undertakes not to destroy, alter, disable or otherwise damage any data, programs, electronic documents or other materials available on the WEBSITE. Likewise, the USER undertakes not to introduce programs, viruses, macros, applets, ActiveX controls or any other element that causes or may cause alterations to the computer systems of the owner of the WEBSITE or of any third party.

Any USER who breaches these prohibitions shall be liable for any claims arising as a result thereof. CALLNAK may take any measures it deems necessary, including the deletion or blocking of the offending USER’s account or registration, without the USER being entitled to any compensation as a result.

CALLNAK reserves the right to modify and/or update, in whole or in part and at any time it deems appropriate, the content of this document, as well as the other terms and conditions and the Privacy Policy. Users are therefore advised to review these documents periodically.

LIABILITY

Access to the WEBSITE shall be the sole and exclusive responsibility of the USER.

CALLNAK has adopted all measures reasonably available to it, taking into account the current state of technology, to ensure the proper functioning of the WEBSITE and to minimise system errors, both from a technical perspective and with regard to the content published on the WEBSITE, as well as to prevent the existence and transmission of viruses and other harmful components to USERS’ computer systems. However, absolute security cannot be guaranteed.

CALLNAK shall not be liable for the quality of the service, access speed, proper functioning, availability or continuity of the WEBSITE.

MINORS

USERS who are minors must obtain the prior consent of their parents, legal guardian or legal representative before accessing the WEBSITE. Those responsible for the minor shall ensure that the content accessed is appropriate for their age.

INTELLECTUAL PROPERTY, INDUSTRIAL PROPERTY AND IMAGE RIGHTS

CALLNAK is the owner or, where applicable, the licensee of all content made available on the WEBSITE, including, without limitation, texts, photographs or illustrations, logos, trademarks, graphics, designs, interfaces and any other information or content, as well as the services offered.

No intellectual property, industrial property or any other rights over the WEBSITE shall be deemed to have been transferred to the USER beyond the right to use the WEBSITE under the terms established herein, within the geographical scope and for the period necessary for its lawful use.

Under no circumstances shall the acquisition, contracting, installation and/or use of the services offered by CALLNAK be construed as a waiver, transfer, licence or assignment, whether total or partial, of such rights by CALLNAK or their respective owner.

References to registered trademarks or trade names, or other distinctive signs, whether owned by CALLNAK or by third-party companies, imply a prohibition on their use without the prior consent of CALLNAK or their respective legitimate owners.

Unless expressly stated otherwise, the acquisition, contracting, installation and/or use of the services offered by CALLNAK does not grant the USER any rights over the distinctive signs contained therein.

Likewise, it is prohibited to remove or manipulate any copyright notices or other credits identifying the owners of the rights to such services, as well as any technical protection measures, digital fingerprints or other protection mechanisms or information incorporated therein.

DATA PROTECTION

In compliance with the applicable legislation on the protection of personal data and the free movement of such data, the USER acknowledges having been informed of the conditions governing the protection of personal data and, where applicable, accepts and consents to the processing of such data by CALLNAK in the manner and for the purposes set out in the Privacy Policy.

LINKS TO OTHER WEBSITES

Where the WEBSITE contains links to other websites through different buttons, links, banners, embedded content or other means, CALLNAK informs USERS that such websites are managed directly by third parties.

Consequently, CALLNAK shall not assume any liability whatsoever for any aspect relating to the platform or website to which a link may be provided from the WEBSITE, including, without limitation, its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its content in general.

In this regard, should USERS become aware that activities carried out through such third-party websites are illegal or contrary to public morals and/or public order, they must immediately notify CALLNAK so that the relevant access link may be disabled.

In any event, the establishment of any link from the WEBSITE to an external website shall not necessarily imply the existence of any relationship, collaboration or dependency between CALLNAK and the person responsible for such external website.

LINKS FROM OTHER WEBSITES TO THE CALLNAK WEBSITE

CALLNAK does not authorise links to the WEBSITE from websites containing unlawful, illegal, degrading, obscene or, in general, content that contravenes applicable laws, public morals, public order or generally accepted social standards.

In any event, USERS may establish links to the PLATFORM on websites owned by them, provided that the following conditions are met:

a) The link may not reproduce the content of the PLATFORM, or any part thereof, in any manner.

b) It is not permitted to create a browser or border environment around sections of the WEBSITE, nor may the WEBSITE otherwise be modified.

c) No false, inaccurate or incorrect statements or indications may be made regarding the WEBSITE and, in particular, it may not be stated or implied that CALLNAK has authorised the link or has supervised, endorsed or otherwise assumed responsibility for the content or services offered or made available on the website where the link is established.

d) The website containing the link to the WEBSITE shall not contain unlawful content, content contrary to generally accepted standards of morality and good conduct or public order, nor content that infringes any third-party rights, including intellectual or industrial property rights, rights to honour, privacy or one's own image, or any other rights, nor content contrary to the regulations governing the protection of personal data.

CALLNAK does not have the capacity or the human or technical resources to identify, control or approve all information, content, products or services provided by other websites that establish links to the WEBSITE.

CALLNAK shall not assume any liability whatsoever for any aspect relating to the website establishing such a link to the WEBSITE, including, without limitation, its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its content in general.

APPLICABLE LAW AND JURISDICTION

Any dispute or matter arising from or relating to this WEBSITE shall be governed by the Spanish legislation in force at the time the dispute arises.

For the resolution of any dispute that may arise between CALLNAK and the USER, both parties agree to submit to the jurisdiction of the Courts and Tribunals of the city of Elche (Alicante), Spain, unless otherwise required by mandatory applicable law or other imperative legal provision.
